New technical conditions: a choice that must be conscious.

As we already know according to the episodic regulations of the amendment to the Act on the Professional Self-Governments of Architects and Civil Engineers and the Construction Law, which will soon be published, the current technical conditions that buildings must meet will still be applicable for over 18 months, provided that the investor submits a declaration regarding the application of these regulations.

When the new regulation on technical conditions comes into effect, investors and designers must consider which legal regulations to base their projects on during this time. The answer does not have to be simple at all. Indeed, we are accustomed to the current regulations, so it is probably easier to apply them, but...

❓Which regulations are better for my situation? This is the first issue worth considering. In terms of fire safety, the changes are very significant, but this does not mean that all new provisions are more demanding. Some new regulations increase requirements, but some amendments soften the previously applicable rules. Therefore, it cannot be assumed in advance that the previous regulations are more lenient, making it easier to apply the old ones.

🤔 Forward-thinking - a building does not stop existing after it is constructed, and during its operation, there is often a need to make certain changes regarding reconstruction, expansion, or changes in usage. Designing a building now according to the new legal regulations may save time and money in the future, as it will not be necessary to adapt an existing building to new regulations in case of such changes, nor will there be a need to obtain approval for alternative solutions or deviations, which also takes a lot of time and incurs certain costs.

🔥 Some newly designed regulations raise requirements, especially in the areas of limiting fire zones, effectively separating fire zones, or the fire resistance of building elements - indeed, on one hand, these are certain restrictions and higher costs, but on the other hand, this represents a real improvement in safety, which both increases the resilience of the building and its operation to the occurrence of fire and can significantly affect the survival of the enterprise; it can also have a real financial impact on the costs of insuring the building due to reduced risk - the investor should comprehensively consider all circumstances to assess the real impact on the profitability of the investment.

🧑‍🦽‍➡️The draft of the new regulation introduces regulations in areas that are directly unregulated by dedicated provisions, such as photovoltaic installations, energy storage, and evacuation of people with special needs - currently, we design these areas based on technical knowledge; the new provision will at least partially indicate acceptable solutions.

The final decision on which regulations to apply will belong to the investor, but it is advisable that they make it based on comprehensive information and appropriate analysis that allows for an informed decision rather than an unfounded choice of seemingly easier solutions. The above are just some of the considerations worth taking into account.
